THE case of a man charged with criminal damage and possession of a weapon who has been trying to get his case dismissed will go to trial.

Waseem Malik, of Handover Way in Windsor, has been charged with criminal damage and possession of a stun gun in Windsor on December 8, 2020.

However, the 58-year-old has requested his case be dismissed, claiming the Crown has failed to provide proof that he is the defendant charged with the offences as well as providing sufficient evidence of the alleged incident.

He has previously refused to stand in the dock, as well as later refusing to enter a courtroom resulting in him almost being arrested.

Malik also failed to attend court on September 11 leading to a warrant not back for bail being issued.

As a result, a hearing took place on Thursday (October 12) to establish the identity of the defendant as well as if there are grounds to dismiss the case in favour a Section 36 – which encourages parties to settle disputes without going to trial.

However, the courts have confirmed that the trial is still listed for April 8 next year with a time estimate of five days.

The case has next been listed for a pre-trial review in the same court on March 11, 2024.
